Pixel Tanx Terms of Service

About these terms
These terms govern your use of Pixel Tanx and its account and online game services, operated by Kollectr LLC, doing business as Atomic Kiwi ("we," "us," or "our"), based in Minnesota, United States. By using the service, you agree to these terms. If you do not agree, do not use the service.

Eligibility and accounts
Pixel Tanx is a general-audience arcade game, not a service directed to children under 13. If you are not legally able to agree to these terms yourself, your parent or legal guardian must review and agree to them on your behalf. Permission to accept these terms does not replace any parental consent required by applicable privacy law.
Provide accurate account information, safeguard your credentials, and do not use another person's account without permission. Notify us if you believe your account has been compromised. Do not impersonate another person or use a display name that is abusive, unlawful, or misleading.
Some features require an account and an internet connection. Available sign-in methods can vary by platform. A shared Atomic Kiwi account may be used by multiple games, but membership in one game does not itself grant access, purchases, or progress in another.
Permission to use the game
Subject to these terms, we grant you a limited, personal, non-exclusive, non-transferable license to install and play the game for your own non-commercial entertainment. We and our licensors retain ownership of the game's code, artwork, audio, branding, and other protected content. These terms do not transfer ownership of that content to you.
Do not redistribute or sell the game or its assets, circumvent access controls, or reverse engineer the service except where applicable law permits despite this restriction. Nothing here limits rights that applicable law does not allow us to restrict.
Fair play and acceptable use
Do not:
- Cheat, manipulate match results, exploit vulnerabilities, or use unauthorized automation that interferes with fair play.
- Attack, overload, probe without authorization, or disrupt the game, accounts, networks, or multiplayer servers.
- Steal credentials, access another player's private information, or attempt to bypass authentication or payment controls.
- Harass, threaten, impersonate, or discriminate against other people through available game features or support channels.
- Use the service for unlawful purposes or infringe another person's rights.
Report suspected vulnerabilities privately to support@atomickiwi.studio rather than exploiting them or exposing player information.
Online services and test releases
Online features depend on connectivity, service availability, and compatible client versions. We may maintain, rebalance, update, or replace features. We do not promise uninterrupted access or indefinite operation of multiplayer servers. Where material changes affect paid rights, we will comply with applicable notice, refund, and consumer-protection obligations.
Alpha, beta, and internal-test builds may contain errors, change substantially, or lose or reset test data. Test builds can use separate servers and accounts. Test participation does not guarantee that data, access, or progress will transfer to a public release. These limitations do not remove rights provided by applicable law.
Purchases
The current release does not offer in-app purchases. If purchases are introduced, their price, included content, and applicable conditions will be disclosed before purchase, subject to storefront rules and mandatory consumer rights. These terms do not promise future paid features or require you to buy them.
Feedback
You may choose to send feedback or suggestions. You permit us to use that feedback to improve our services without an obligation to compensate you. This permission does not transfer ownership of unrelated work or change our obligations concerning personal information or information covered by a separate confidentiality agreement.
Suspension, termination, and deletion
We may restrict or suspend access where reasonably necessary to address serious or repeated violations, fraud, security risks, or legal obligations. Where appropriate and lawful, we will provide the reason and an opportunity to contact support. You may ask us to review an access restriction at support@atomickiwi.studio.
You may stop using the game at any time. To delete your account, use Profile → Delete Account in the game and confirm the warning, or request deletion by emailing support@atomickiwi.studio. See the Privacy Policy and account-deletion request page for scope, verification, and retention details. Uninstalling the game does not delete your account. Deleting a shared Atomic Kiwi account can affect other linked game profiles; the deletion process should explain the scope before you confirm it.
Termination does not eliminate obligations that by their nature survive, nor does it override mandatory rights regarding paid content or personal information.
Disclaimers and responsibility
To the extent permitted by applicable law, the service is provided on an "as is" and "as available" basis, without promises that it will be error-free or suitable for every device. We remain responsible where applicable law requires it.
To the extent permitted by law, we are not responsible for indirect or consequential losses resulting from use of the service. No exclusion in these terms applies where prohibited by law, including liability that cannot be excluded for fraud, intentional misconduct, gross negligence, or death or personal injury caused by negligence. Your mandatory consumer rights remain unaffected.
Applicable law and disputes
These terms are governed by the laws of Minnesota and applicable United States federal law, without regard to conflict-of-law rules, except where mandatory law requires otherwise. Courts of competent jurisdiction in Minnesota may hear disputes concerning these terms on a non-exclusive basis. Nothing in these terms deprives you of mandatory consumer protections under the laws of your place of residence or any right to bring a claim in a court or forum available to you under applicable law.
Please contact support@atomickiwi.studio first so we can try to resolve a concern. This does not prevent you from using courts, regulators, or other remedies available under applicable law. These terms do not impose mandatory arbitration or a class-action waiver.
Changes to these terms
We will publish revised terms with an updated effective date and provide appropriate advance notice of material changes where required. If a change requires your agreement under applicable law, we will obtain it before applying that change to you. Changes do not retroactively remove rights attached to an existing purchase.
